A Free Sale and Commerce Certificate is a trade document certifying that a product is freely sold in the exporter's domestic market and is not banned or restricted there. Many importing countries insist on it before allowing a consignment in, because it is the simplest way for a foreign regulator to establish that the goods are lawfully marketed in the country of origin. In India the certificate is issued by the DGFT through its Regional Authorities under the Foreign Trade Policy, and Paragraph 2.34 of the Handbook of Procedures sets out the procedure. It is typically sought for products outside the reach of the Drugs and Cosmetics Act, 1940 - items such as food supplements, cosmetic-adjacent goods, medical devices and general merchandise - because drugs and cosmetics proper are certified by their own regulator. Until this notice each application was examined, verified and approved by hand at a Regional Authority. The new workflow keeps that route for exceptions but lets a rule-satisfying application generate its certificate straight from the system.

This is a small notice with a large template behind it. Trade facilitation reform in India has moved steadily from paper to portal - electronic Bank Realisation Certificates, online Importer-Exporter Code issuance, faceless authorisation processing - and the direction of travel is to reserve human scrutiny for exceptions rather than apply it to every file. Automating a routine certificate cuts the turnaround for the large majority of applications while the risk-management layer preserves the ability to catch abuse after the fact. That trade-off, ex-ante clearance versus ex-post audit, is the same design principle used in faceless tax assessment and in risk-based customs clearance, and it is a favourite conceptual angle in examination questions on ease of doing business. For exporters, particularly MSMEs without dedicated compliance staff, the delay in obtaining a supporting document is often a bigger obstacle than the tariff itself.
