The Directorate of Revenue Intelligence has dismantled a network that imported South-East Asian areca nuts into India while declaring them as Bangladeshi origin, to claim duty-free treatment under the South Asian Free Trade Area (SAFTA).
The investigation has so far revealed customs duty evasion of more than Rs 2,500 crore; nine persons have been arrested, about Rs 75 lakh in cash and a live consignment of around 160 MT of areca nuts were seized.
Areca nut imports normally attract a Basic Customs Duty of 100%, while imports meeting SAFTA's rules-of-origin criteria enter duty-free — the gap that made the fraud profitable.
Goods were routed through an export processing zone in Bangladesh with containers and bags changed, and SAFTA certificates of origin were fraudulently obtained; a customs broker firm's licence has been suspended.
A free trade agreement lowers duty on goods originating in a member country. Without a test of where a good actually came from, a trader could ship goods from a non-member into the cheapest member country, do nothing to them, and re-export them into the destination market at the concessional rate — a practice called trade deflection. Rules of origin prevent this by requiring either that the good be wholly obtained in the exporting member, or that enough value be added there: SAFTA requires 40% domestic value addition plus a change in tariff heading at the four-digit level for non-LDC members, and 30% plus a change in tariff heading for LDC members. A certificate of origin issued by the exporting country's designated authority is the document that certifies this. The fraud in this case attacked exactly that document — the goods never became Bangladeshi in any economic sense; containers and bags were merely swapped in an export processing zone.
