8 sections below — scroll or usetocto jump
  • 1

Elections to Legislative Assemblies are fundamental to India's democratic structure, ensuring representation at the state level.

  • 2

The Election Commission of India (ECI), an autonomous constitutional body, is solely responsible for conducting free and fair elections across the country.

  • 3

The concept of 'perfect election' refers to ongoing efforts and reforms aimed at enhancing transparency, integrity, and voter participation in the electoral process.

  • 4

Key challenges include strict adherence to the Model Code of Conduct, combating malpractices, and ensuring accessibility for all eligible voters.

  • The Election Commission of India (ECI) is an autonomous constitutional body responsible for administering elections in India.
  • Article 324 of the Indian Constitution vests the superintendence, direction, and control of elections in the ECI.
  • State Assembly elections, along with Parliamentary and Presidential/Vice-Presidential elections, are conducted by the ECI.
  • The Model Code of Conduct (MCC) is a set of guidelines issued by the ECI that comes into effect from the announcement of election dates until the declaration of results.

Election Commission of India (ECI)

Responsible for the superintendence, direction, and control of the preparation of electoral rolls for, and the conduct of, all elections to Parliament and to the Legislature of every State and to the offices of President and Vice-President.

Head: Chief Election Commissioner (CEC) and two Election Commissioners (ECs)HQ: New Delhi

Article 324 of the Indian Constitution

Establishes the Election Commission of India and vests in it the power of superintendence, direction, and control of elections.

Representation of the People Act, 1950

Provides for the allocation of seats in, and the delimitation of constituencies for, the House of the People and the Legislatures of States, the qualifications of voters, and the preparation of electoral rolls.

Representation of the People Act, 1951

Provides for the conduct of elections to the Houses of Parliament and to the House or Houses of the Legislature of each State, the qualifications and disqualifications for membership of those Houses, the corrupt practices and other election offences, and the decision of doubts and disputes arising out of or in connection with such elections.

Model Code of Conduct (MCC)

The Model Code of Conduct is a set of guidelines evolved with the consensus of political parties, which governs the conduct of political parties and candidates during elections. It aims to ensure a level playing field, prevent malpractices, and maintain peace and order during the electoral process. Though not legally enforceable, the ECI enforces it through its constitutional powers.

Simple Analogy: The MCC acts like a rulebook for a sports match, ensuring all players (parties/candidates) compete fairly and ethically, without resorting to unfair tactics or disrupting the game (election process).

Constitutional Bodies

The ECI is a vital constitutional body, and its independence and powers are crucial for the functioning of Indian democracy.

Federalism

The conduct of state assembly elections by a central body like the ECI highlights the cooperative federal structure of India, where a unified electoral authority ensures consistency and fairness across states.

Governance and Accountability

Electoral reforms and the pursuit of fair elections are central to good governance, ensuring democratic accountability and public trust in the political system.
