The Uttar Pradesh Cabinet, acting by circulation on 22 August 2026, allowed female state government employees to take 180 days of maternity leave twice during their service.
The earlier condition of a minimum two-year gap between the first and second maternity leave has been removed.
The decision amends Rule 153(1) of the Uttar Pradesh Financial Handbook, Volume II, Parts 2 to 4, and extends the same 180-day benefit to adoptive mothers.
It follows rulings of the Allahabad High Court - by the Lucknow Bench on 14 August 2026 and the Allahabad Bench on 28 July 2026 - holding that state executive rules cannot override the Maternity Benefit Act, 1961 and the Code on Social Security, 2020.
The same round of circulation approvals also raised the monthly honorarium of about 3.5 lakh school cooks from Rs 2,000 to Rs 3,000.
