The National Commission for Scheduled Castes has ordered an inquiry, under Article 338 of the Constitution, into alleged non-implementation of reservation in the recruitment of lecturers by the Punjab Education Department.
The complaint, from Rajya Sabha MP Shri Tarun Chugh, alleges that Scheduled Caste candidates were denied reservation benefits in recruitment to 1,013 lecturer posts.
A notice to the Chief Secretary of Punjab seeks the facts, the action taken and all related records including the recruitment notification and the reservation roster, within seven days.
The Commission has warned that if no response arrives in time, it may exercise the powers of a civil court and summon officials for personal appearance.
NCSC Chairman Shri Kishor Makwana called the alleged denial of reservation benefits a very serious matter.
Establishes the National Commission for Scheduled Castes; empowers it to investigate and monitor safeguards for SCs, inquire into specific complaints, and exercise the powers of a civil court while doing so, including summoning attendance from any part of India and requiring production of documents
Converted the earlier arrangement into a multi-member National Commission for Scheduled Castes and Scheduled Tribes appointed by the President
Bifurcated the joint commission; Article 338 was confined to the NCSC and a new Article 338A created the National Commission for Scheduled Tribes, which came into being on 19 February 2004
Inserted by the 102nd Amendment in 2018 to give constitutional status to the National Commission for Backward Classes, completing the trio of commissions
Permits the State to reserve appointments or posts in favour of backward classes not adequately represented in the services — the enabling provision behind a recruitment roster
Requires SC and ST claims to be taken into consideration, consistently with the maintenance of efficiency of administration, in appointments to services; the Supreme Court has read this as not barring relaxations that the Constitution itself permits
Investigates and monitors safeguards for SCs, inquires into complaints of deprivation of rights, advises on socio-economic development planning, and reports to the President
The same functions for Scheduled Tribes; created by the bifurcation of the earlier joint commission
Examines complaints and welfare measures for socially and educationally backward classes; statutory since 1993 and constitutional since 2018
A roster is a numbered running sequence of posts in which specified points are earmarked for each reserved category. It converts a percentage into identified vacancies, so compliance can be audited post by post rather than argued over in aggregate.
Simple Analogy: A seating chart, not just a quota count.
Set the 50 per cent ceiling on reservations and excluded the creamy layer for OBCs — the framework within which any recruitment roster operates
Restored and clarified reservation in promotions and the treatment of carry-forward vacancies after judicial rulings, the other half of the Article 16 story
Empowers the President to specify, by public notification for each state or UT, the castes deemed Scheduled Castes; Parliament alone may modify the list
