The Regulations were framed to move campus anti-discrimination rules from advisory guidance to an enforceable framework. They define discrimination broadly - direct or indirect, explicit or implicit unfair treatment on grounds of caste, religion, race, gender, place of birth or disability, including conduct that undermines equality in education or human dignity - and they extend the caste-discrimination protection explicitly to Other Backward Classes, which the earlier framework did not do. Institutionally, every higher education institution must set up an Equal Opportunity Centre to promote equity and receive complaints, and must constitute an Equity Committee under it, chaired by the head of the institution and carrying compulsory representation from SCs, STs, OBCs, women and persons with disabilities. It is precisely the breadth of the definition and the reach of the enforcement machinery that the petitioners have attacked, and that the Court described as prima facie vague and open to misuse.

The dispute is a clean illustration of how delegated legislation is tested. The UGC's rule-making power flows from the 1956 Act, but a regulation must still stay within the statute and within Articles 14, 15 and 16, and the challenge is that the definition in Regulation 3(1)(c) draws the protected class too narrowly to survive an equality test, while the wider definition of discrimination is too vague to be administered fairly. The Court's response was unusual in a second way: instead of leaving a vacuum, it used Article 142 to keep the 2012 Regulations alive, so campuses have continued under the older, weaker framework for months. The Centre's statement that the rules are under reconsideration signals that the eventual resolution may be a redrafted set of regulations rather than a judgment on the existing ones - the pattern where a government withdraws and re-notifies rather than defending a stayed instrument to the end.
